PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l1, AR 635-200, by reason of entry level performance and conduct, with an uncharacterized discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and that applicant be transferred to the individual ready reserve (IRR). On 13 July 1992, the separation authority waived further rehabilitative efforts, and directed that the applicant be transferred to the individual ready reserve (IRR), and be released from active duty with a characterization of service of an uncharacterized.

         b. On 27 July 1992, the applicant was released from active duty. At the time of discharge, the applicant had completed 3 months, and 27 days of active military service in the period under review and had a total of 5 years, 6 months, and 28 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

 (1), (2), (3), (4), and (5) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence in the applicant’s record shows that on 11 December 1991, the applicant signed an addendum to his enlistment contract, Statement for Enlistment (US Army Special Forces Prior Service Enlistment Option), indicating that he understood Item 1e, which states in pertinent part, “I understand that if I fail to successfully complete any phase of required training (BT, BAT, or SFAS), I will be separated from the Army in accordance with AR 635-200, Chapter 11, Entry Level Status.” The applicant failed to successfully complete the Special Forces Assessment and Selection Course, and was properly separated as stated in his enlistment contract under the provisions of Chapter 11, AR 635-200. The Board, being convinced that the characterization of service and the reason for discharge were both proper and equitable, voted to deny relief.
         
         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
